‘In the case of Re C and D (Refusal to Hold a Fact-Finding Hearing) [2026] EWFC 155, Mrs. Justice Knowles refused the application of a local authority in care proceedings to hold a separate fact-finding hearing. The principal issue before the court was whether a fact-finding hearing was necessary and proportionate. Naturally, the case was very fact specific, but the court provided a useful and succinct summary of the applicable principles when determining this issue.’

‘In financial remedy cases involving disputed third-party interests, a question often arises as to whether an FDR should take place before or after a contested preliminary issue hearing. These intervenor cases often involve a family member who either claims to have a beneficial interest in a property registered in the legal name of one of the spouses, or who is the legal owner of a property which is said to be partially or wholly beneficially owned by one of the spouses. In either case the family member may be joined to the proceedings to protect their property interests. There appears to be a view shared by legal professionals that the number of these ‘bank of Mum and Dad’ type cases are on the rise.’
