“Today I am talking to John Cooper QC. The DPP is holding a series of round table meetings to consider where the law should be in relation to online social media spoken and written. Rather strangely – while the DPP invited lawyers who have been involved in recent high profile cases and some lawyers who weren’t even peripherally involved – Keir Starmer QC did not extend an invitation to leading criminal silk John Copper QC who actually led the team in the celebrated Paul Chambers Twitterjoketrial case – which the team won.”

“‘The single biggest attack on access to justice since the legal aid system was introduced’. That’s the view of the Law Society on the government’s controversial proposals to reform the civil justice system in England and Wales. But the government argue that the legal aid system has become unaffordable and along with no win no fee has helped create a litigious society. They say the current system is a boon for lawyers, while draining resources from organisations like the NHS and leaving many small businesses in fear of legal action. The Government are planning to scrap legal aid in some areas and make fundamental changes to no-win no fee. The aim is to bring down costs and encourage alternatives to going to court. But the bill to introduce these changes has been having a rocky ride in Parliament and there is widespread opposition to the reforms. Advice centres, lawyers and even some from the government’s own benches say the changes will deny justice for vulnerable people, and will ultimately end up costing the government more money. In the first programme of a new series of Law in Action, Joshua Rozenberg examines the arguments and the likely impact of the contentious changes.”

“Today I am talking to Jeremy Hopkins, a practice manager at 3 Verulam Buildings, the Chambers of Ali Malek QC – a leading and well known commercial set. Given the recent TV programme Silk (and the arguably better version of Peter Moffat’s writing, North Square – both series featuring extremely cunning clerks at the very centre of the action… I thought it would be interesting to get an inside track on this world from Jeremy…. but first……. I would like to get a view on the real world of practice managers / clerks, the state of the legal profession today and his thoughts on the changes to the legal landscape coming in the wake of the the coming into force of The Legal Services Act this autumn.”

“Today I am talking to Nichola Higgins, Chairman of the Young Barristers Committee. On the 30th March of this year, the CPS announced:

‘The Crown Prosecution Service (CPS) is today (30/3/2011) launching a new scheme for the delivery of prosecution services in court. All advocates undertaking prosecution work in the Crown Court (and Higher Courts) from October must be members of new, quality-controlled CPS Advocate Panels. The panels will be open to all barristers and solicitor advocates, and panel members will complement and work alongside CPS in-house advocates. Although the overall number of advocates on the panels will be reduced compared to the current lists, selected advocates will have more opportunity to undertake prosecution work. All current counsel lists will be abandoned when the panels commence on 1 October.’

We also looked at the broader health of the Criminal Bar, the impact of legal aid and the prospects for students contemplating a career at the Criminal Bar.”

Research skills lie at the root of all legal work, whether in academe or practice, so we are going to look at the skills needed and resources available to law students and lawyers in the modern era. We may even have time to look at the value of legal blogging and social media for younger lawyers and not so young lawyers.”

There are many dangers in doing so. There could well be *unintended consequences* and Carl Gardner says that the drafting of this legislation will need especial care.”

“At the half way stage of the World Cup, police forces across the UK are paying unsolicited visits to men with a record of domestic violence. It’s a strategy recommended by the Association of Chief Police Officers. According to ACPO, research shows that domestic violence peaks during big sporting events like the World Cup. Many police forces have therefore concluded that it makes sense to let potential perpetrators know they are being watched. As Joshua Rozenberg finds when he sees the policy in action in Nottinghamshire, police on the ground belive the policy is working. But a closer look at the evidence casts doubt on whether there really is such a link and traces the idea that there is back to an urban myth from the United States.”

“Joshua Rozenberg investigates how the police, the courts and those responsible for protecting personal data strike a balance between the need to safeguard civil liberties and the police’s responsibility to prevent crime. Are there enough safeguards to protect the public from being unfairly linked with criminals? Is maintaining public order being used as an excuse to engineer a surveillance society? Or are the authorities simply taking the minimum steps to ensure a determined and well-organised minority of protesters bent on disruption do not wreck the lives of the law-abiding majority?”

He looks at the impact on the Rule of Law given the proposed cuts to civil and criminal legal aid. He discusses the globalisation of legal services and international regulatory standards. Lastly, a bit of futurology, Chris discusses the likely legal landscape in the next five years.”
