<p>&#8220;Where a part-time locum doctor, as a step towards achieving a consultant&#8217;s post, took a one-year full time training post at a lower rate of pay but under the relevant NHS terms and conditions was entitled to pay protection, that entitlement was not limited to preserving her previous annual earnings but required her employer to pay all her new full-time hours at an hourly-rate equivalent to her previous part-time work.&#8221;</p>

				<content:encoded><![CDATA[<p>&#8220;On 21st March 2013 the House of Commons Justice Committee published a report about the ICO, recommending, among other matters, that the ICO should be given the power to carry out compulsory data protection audits of NHS Trusts and local authorities. With uncanny speed, on 25th March 2013 the Ministry of Justice (MOJ) published a consultation document on the proposed extension of the ICO’s compulsory audit powers to cover NHS bodies. Despite the coincidence of timing, the MOJ’s proposal is not in fact a response to the Justice Committee’s report, but is prompted by a recommendation from the ICO itself.&#8221;</p>

She was alleged by a member of the public to have breached patient confidentiality whilst travelling on a train (an allegation that might cause lawyers who work on trains pause for thought&#8230;). Her employer Trust appointed an outside psychiatrist to investigate the allegations under the Trust&#8217;s procedures, implementing &#8216;Maintaining High Professional Standards in the Modern NHS&#8217;. The case manager, on reviewing the investigator’s report, decided that the matter should be brought before a disciplinary hearing at which Dr. Chhabra would face allegations of gross misconduct that may have led to dismissal. Separately the Trust referred capability concerns relating to Dr. Chhabra that had also been considered in the investigator&#8217;s report, to the National Clinical Assessment Service (&#8216;NCAS&#8217;).&#8221;</p>

<p>&#8220;It had been unlawful for the Scottish Ministers to fail to make the necessary regulations defining a who was a &#8216;qualifying patient&#8217; detained at a &#8216;qualifying hospital&#8217; and thus entitled to apply for a declaration from the Mental Health Tribunal for Scotland that he was a person detained under conditions of excessive security pursuant to section 268 of the Mental Health (Care and Treatment) (Scotland) Act 2003 which came into force on 1 May 2006 pursuant to section 333(2) of that Act.&#8221;</p>
