				<content:encoded><![CDATA[<p>The Bar Council, which represents barristers in England and Wales, has today stated that it has no plans to develop a quality system to facilitate price competitive tendering (PCT) for criminal legal aid. The Bar Council believes that real quality is based on choice of service providers, not price alone, on which the Government&#8217;s model is based. The Bar Council&#8217;s response to the Ministry of Justice&#8217;s consultation clearly sets out its position on this issue. </p>

				<content:encoded><![CDATA[<p>&#8220;As I mentioned in &#8220;Intellectual Property Litigation &#8211; the Funding Options&#8221; 10 April 2013, it was possible until the 31 March 2013 for a litigant to enter an agreement with his or her solicitors and counsel known as a conditional fee agreement (&#8216;CFA&#8217;) whereby the lawyers would look to the other side for payment not only of their assessed costs but also of an uplift known as a success fee and the premium for insurance against their own and the other side&#8217;s costs in case of failure known as after-the-event (&#8216;ATE&#8217;) insurance if they won the case or obtained a satisfactory settlement. As I also mentioned in that article, it is still possible to enter a CFA but any success fee and ATE insurance premium must now be paid by the successful party &#8211; usually out of any damages or accountable profits he or she may receive.&#8221;</p>

If the government and the senior judiciary had yet to say what was to come on, respectively, damages-based agreements and big-ticket costs budgeting, perhaps they were still open to persuasion?&#8221;</p>

				<content:encoded><![CDATA[<p>&#8220;As part of the Jackson Reforms the much talked about Damages-Based Agreements Regulations 2013 come into force on 1st April 2013. Damages Based agreements (&#8216;DBAs&#8217;) open up the prospect of fees becoming entirely divorced from the actual hours worked on a case. This can lead to much higher fees than those which will arise using the hour-based method, even on a CFA with a 100% uplift. However, there are some potentially serious implications to consider. Don McCue takes a closer look at the potential impact of using DBAs, how they compare to Conditional Fee Agreements (&#8216;CFAs&#8217;) in different litigation scenarios, and how DBAs relate to the Solicitors Regulation Authority (&#8216;SRA&#8217;) Code of Conduct.&#8221;</p>
